It was about 2 years ago when we walked into the office to have a consultation meeting with James Hammond. He was very kind and thorough to explain the process and we were assured that this would be the agency we wanted to go for if we had to proceed our visa application. Lara took on the journey with us this year from May till September and she was prompt to emails and any inquiry we had along the way. I hired Jackson Taylor on 16/11/15 to apply for a Business Sponsorship. The application was denied on the grounds of 2.59(c) – lawfully operating within or outside of Australia. We were. This is where the case should have ended in respect to s.347 of the Act. Section 338 of the Act and r.4.02(4) of the Migration Regulations 1994 which prevented the decision from being reviewed by the AAT. Jackson neglected to inform me of this and risk involved stating “we consider that the Business Sponsorship application has a good chance of success if received at the MRD of the AAT” while understanding of why the application was refused. A year went by and we were growing the business. My partner Loys’ student visa was expiring so I sought advice. Both “solutions” meant that I would need to leave Australia and wouldn’t be allowed in until and if it was approved. That wasn’t an option for the company to leave Australia for an extended and uncertain period of time. I was working 70-hour weeks without rest. We were stuck renewing the expensive student visa. Another year went by and the company was growing. We found a home we loved. We bought a black Labrador, Luna. Life felt like it was going to be okay. We were finally feeling like we were home. We were hiring staff and creating something that we have put our heart and soul into. All the endless days of working, not taking a break, scraping by, was finally paying off! There was still the stress, but we knew it would be worth it in the end! The end was sooner than we thought. Jackson advised that the AAT refused to review the sponsorship because they did not have jurisdiction to make a review. I don’t think my heart could have sunk deeper. The AAT was giving us a chance to comment on their decision. They were reviewing to review the application. The irony of that still gets me. We got back home, I collapsed with my dog in my arms. He was wrong again. The refusal was for the business and not my 457 so now I was in a new pit of hell. I was on borrowed time. Since then, we have worked harder than before to make sure that the company can survive, and our employees can keep their job. We’re still not sure if it will. The company can’t afford to replace 2 people working for scraps. 3 years of sweat and tears potentially wasted. I was lost. I’m still lost. I had asked Jackson if he knew this outcome was a possibility to which he state “No, this has never occurred before” and, “The law has been as it currently stands for a number of years” which indicates that he knew of this legislation but failed to mention it. Also, there has been many cases with the same conditions and the same outcome so saying this was a first is a bold lie. He stated “If you wish to use another agent for this process please feel free. You have no ongoing commitment to us and I can recommend you to those I consider the best agents in Melbourne/the country.” That’s funny, there is no more “ongoing” for me, it’s the end of the road. I gave Jackson an opportunity to right this wrong, so we can both move on and Loys and I could start rebuilding. I requested compensation for unnecessary costs, legal fees and a fair value for 3 years lost. While we’d rather have that time back, it would ease some of the worry about being forced to move to a new country with VERY little saved and everything invested in the company. We can’t even afford to take Luna with us. He didn’t respond. He couldn’t even show the slightest interest to respond. Mr Hammond did. I’m sure he thought I wouldn’t act. The thing he failed to consider, like the legislations, I have nothing left to lose. While I wouldn’t want to be responsible for someone else’s path, I would advise to think twice before choosing Hammond Taylor. Ensure they have a FULL understanding of current laws and what happens if your visa is refused. All this heartbreak and stress would have avoided if Jackson didn’t send us down a wild goose chase.
